Release Guarantee — Terms

In short: a release offer from a qualifying label within 12 months, or your Fastlane coaching continues free of charge until you have one. Requirements: active Fastlane subscription, Ableton Live as your DAW, at least 90% of offered feedback sessions submitted, work on one focus track, feedback demonstrably applied, evidenced submission to the labels named by the Provider, acceptance of a qualifying release offer; purchase through the regular Fastlane checkout; not available via order-bump offers or other promotions. Remix competitions and other contests with a limited number of winners are not part of the guarantee and do not count towards it. The details are governed by the terms below. Applies to new Fastlane contracts only. The German version prevails in case of doubt.
§ 1 Subject matter and relation to the coaching contract
(1) These terms govern the Release Guarantee granted by Andreas Geißinger, Schumannstr. 9, 81679 Munich, Germany ("Provider", program "Psytrance Blueprint") to participants of the Fastlane tier, in addition to the services under the coaching contract.
(2) The Release Guarantee is an independent guarantee promise by the Provider. The coaching contract (see Terms of Service) remains a contract for services; the guarantee does not turn it into a contract for work. Under the coaching contract the Provider continues to owe the agreed coaching services, not the occurrence of a specific result.
(3) The participant's statutory rights are not limited by this guarantee. It applies in addition to the statutory right of withdrawal and the 14-day money-back guarantee.
(4) The Release Guarantee applies exclusively to Fastlane contracts concluded after these terms come into force. It does not apply to contracts concluded before that date.
(5) The Release Guarantee applies exclusively to Fastlane subscriptions concluded through the regular Fastlane checkout, including the introductory price shown there. In particular, it does NOT apply to Fastlane subscriptions obtained through the discounted upgrade add-on in the Producer tier checkout (the "Upgrade to Fastlane" order bump) or a comparable add-on offer of another tier, nor when any other discount, voucher or promotion is used.
§ 2 Definitions
(1) Focus Track: the one music title the participant works on under the Release Guarantee (§ 4 (3)).
(2) Qualifying Label: a music label listed, at the relevant time, in the top 100 of the psytrance label ranking on beatstats.com. The relevant time is the moment the Provider names the label to the participant for submission under § 4 (6); for a Release Offer from a label not named by the Provider, it is the moment the offer reaches the participant. Earlier or later ranking changes are irrelevant. The underlying ranking is that of the preceding twelve months. The Provider documents the ranking at the relevant time by screen capture.
(3) Release Offer: a binding offer by a Qualifying Label to the participant to release the Focus Track on customary market terms. Terms are customary if they correspond to the label's usual conditions for comparable newcomer releases; in particular, the absence of an advance does not make an offer non-customary.
(4) Fulfilment of the guarantee: the guarantee is fulfilled as soon as the participant has received a Release Offer. The actual release date is irrelevant, as it lies within the label's discretion.
(5) Guarantee Period: twelve (12) months, beginning with the participant's first feedback week in the Fastlane tier. Periods of suspension under § 5 do not count towards the Guarantee Period.
§ 3 The guarantee promise
(1) The Provider guarantees that the participant will receive a Release Offer for their Focus Track within the Guarantee Period, provided the participant meets the requirements of § 4.
(2) If no Release Offer has been received by the end of the Guarantee Period, the guarantee case under § 6 occurs.
(3) Remix competitions and any other contests or competitions with a limited number of winners are not part of the Release Guarantee. Being offered such a competition, entering it, and the outcome of it, in particular winning or not winning, neither fulfil the guarantee nor count towards or against the participant's duties under § 4. The guarantee is fulfilled solely through the direct submission of the participant's Focus Track to the labels the Provider names under § 4 (6). Such competitions are a separate, optional offer with no bearing on the guarantee.
§ 4 Requirements and duties of the participant
The Release Guarantee requires that the participant fulfils the following duties throughout the Guarantee Period and any extension under § 6:
(1) Active subscription: the Fastlane subscription remains continuously active. Cancellation, downgrade to another tier, pausing, or payment default of more than 14 days cause the guarantee to lapse (§ 10).
(2) Feedback sessions: the participant submits work-in-progress on time for the agreed feedback sessions. A session counts as missed if no work-in-progress has been submitted by the agreed time. The rate of missed sessions must not exceed 10% of all offered sessions; the participant therefore attends at least 90% of offered sessions. The entire period including any extension under § 6 is decisive. A work-in-progress submission is a current full-length export of the Focus Track showing the progress made since the previous session. A session counts as offered when the Provider has made it available in the participant's personal feedback channel; the Provider documents offered sessions and submissions. Plainly insufficient submissions (e.g. fragments or unchanged earlier exports) count as not submitted after notice in text form.
(3) Work on one track: the participant names their Focus Track no later than in the second feedback week and works on it until a Release Offer is received. A change of Focus Track requires the Provider's prior consent in text form; in that case the Guarantee Period restarts.
(4) Applying the feedback: the participant demonstrably applies the received feedback to their Focus Track. Repeatedly submitting essentially unchanged work-in-progress is in particular not sufficient. The Provider may object in text form to a failure to apply feedback, stating the specific points not applied. The participant then has until the feedback session after next to remedy this. The guarantee lapses only if two consecutive objections are not remedied. A failure to apply feedback also exists where named points are remedied but deteriorations preventing a release are repeatedly introduced elsewhere; this too must be objected to specifically and is subject to the remedy mechanism above. A substantively justified deviation from the feedback does not constitute a failure to apply it, provided the participant explains it comprehensibly.
(5) Third-party rights: the participant warrants that the Focus Track is free of third-party rights, in particular that it contains no uncleared samples, vocals or third-party presets without a licence. The Provider may suspend the guarantee until the matter is resolved.
(6) Label submissions: the Provider names suitable Qualifying Labels and supports the participant in submitting the Focus Track. The participant submits the Focus Track to the labels named by the Provider once the Provider declares the track ready for submission — readiness for submission must not be unreasonably withheld — and puts the Provider in CC on each submission email; where a submission is not made by email, the participant evidences it without delay in text form. This evidence is a prerequisite for the guarantee case under § 6.
(7) Disclosure: the participant discloses to the Provider without delay every Release Offer received and every release of the Focus Track. If the participant conceals a Release Offer, any free continuation under § 6 ends retroactively as of receipt of the offer; services used from that point on must be compensated to the Provider at the regular tier price.
(8) Digital audio workstation: the guarantee applies exclusively to participants who use Ableton Live as their digital audio workstation (DAW). The depth of support promised under the guarantee requires the direct analysis of the participant's project files; Ableton Live is the course DAW.
§ 5 Suspension of the Guarantee Period
(1) The Guarantee Period is suspended for as long as the Provider is unable to offer feedback sessions for reasons beyond its control, in particular illness of a mentor, force majeure, or failure of essential technical infrastructure.
(2) Cancelled feedback sessions are made up after the reason for suspension ends. They do not count as missed within the meaning of § 4 (2).
(3) The Guarantee Period is extended by the duration of the suspension.
(4) In the case of evidenced illness or another hardship not attributable to the participant, the Guarantee Period is suspended upon notice in text form for up to six weeks in total per contract year; sessions made available during this time do not count as offered within the meaning of § 4 (2).
(5) If a mentor becomes permanently unavailable, the Provider ensures the continuation of the feedback sessions through another qualified mentor or personally.
§ 6 Guarantee case and consequence
(1) If no Release Offer has been received by the end of the Guarantee Period and the participant has fulfilled their duties under § 4, access to the Fastlane tier continues free of charge from the billing period following the expiry.
(2) The free continuation covers the full scope of the Fastlane tier, in particular the agreed number of feedback sessions. Feedback sessions during the free continuation relate to the Focus Track.
(3) The free continuation ends as soon as the participant receives a Release Offer or the guarantee lapses under § 10.
(4) The duties under § 4 continue to apply unchanged during the free continuation.
§ 7 Support services in the guarantee case
(1) In the guarantee case the Provider supports the participant beyond the regular feedback with the aim of bringing the Focus Track to release level. The Provider decides on the nature and scope of the measures at its reasonable discretion. Possible measures include in particular: intensified coaching with shortened feedback intervals; a technical rework of the track by the Provider or one of its mentors, in particular mixdown and mastering; a rework of arrangement, transitions and tension curve to the extent required for a release; the replacement or rework of individual sounds and elements.
(2) The Provider is entitled at any time to place the Focus Track with a Qualifying Label itself or to release it on one of its own qualifying labels. Upon presentation of a corresponding Release Offer the guarantee is fulfilled.
(3) Creative authorship of the Focus Track remains with the participant. The services under paragraph 1 are of a technical, craftsman-like nature and serve the completion of the work created by the participant.
(4) To the extent a contribution by the Provider or a mentor exceptionally reaches the threshold of copyright originality, the contributor grants the participant the exclusive right of use, unlimited in territory, time and content, and waives the right to be named as author. The participant may release the track without restriction under their own artist name.
§ 8 Acceptance of the Release Offer
(1) The participant is obliged to accept a Release Offer from a Qualifying Label presented to them.
(2) If the participant declines a Release Offer, the guarantee is nevertheless deemed fulfilled. Any free continuation under § 6 ends in that case.
(3) The label contract is concluded exclusively between the participant and the label. The Provider is not a party to it and is not liable for its performance.
§ 9 No refund or monetary payment
(1) The sole consequence of the guarantee case is the free continuation under § 6.
(2) This guarantee gives no claim to a refund of fees already paid, to a monetary payment, to damages in lieu of performance, or to any other monetary compensation.
(3) The Provider's liability for intent and gross negligence, and for damage arising from injury to life, body or health, remains unaffected.
§ 10 Lapse of the guarantee
The Release Guarantee lapses if a) the subscription is cancelled, downgraded or paused, b) a payment default of more than 14 days occurs, c) the rate of missed feedback sessions exceeds 10%, d) the participant works on several tracks contrary to § 4 (3), e) two consecutive objections under § 4 (4) are not remedied, f) the participant breaches § 4 (5), g) the participant declines a Release Offer (§ 8 (2)), h) the participant breaches the submission or disclosure duties under § 4 (6) or (7), i) the participant does not use Ableton Live as their DAW contrary to § 4 (8), or j) the participant breaches § 11.
§ 11 Conduct
(1) The guarantee lapses with immediate effect if the participant a) passes on course content, access data or recordings to third parties or makes them publicly available, b) shares content from feedback sessions or other participants' work-in-progress without their consent, c) insults, threatens, harasses or discriminates against other participants or mentors, or d) intentionally makes false statements to the Provider, in particular regarding authorship of the Focus Track or the use of third-party content.
(2) In the case of other disruptions of the course, in particular repeated disruption of group calls, the guarantee lapses only after a prior warning in text form and a further breach.
§ 12 Substitute benchmark
If the ranking on beatstats.com becomes permanently unavailable or its methodology changes materially, a comparable, publicly accessible psytrance label ranking takes its place. The Provider names the substitute benchmark in text form.
§ 13 Final provisions
(1) Amendments and additions to these terms must be made in text form.
(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
(3) The law of the Federal Republic of Germany applies. Mandatory consumer-protection provisions of the state in which the participant has their habitual residence remain unaffected.
